2006 – The Overview (Intellectual Property) |

The reform of intellectual property legislation in Serbia has been completed in 2006 thorough enactment of the Law on Special Competencies for Efficient Protection of Intellectual Property Rights (Official Herald of the Republic of Serbia No. 46/2006) and the Law on Appellations of Origin (Official Gazette of Serbia and Montenegro No. 20/2006), as well as through entering into force of the Criminal Code (Official Herald of the Republic of Serbia No. 85/2005, 88/05 and 107/2005).

Implementation of Law on Investment Funds Commenced |
|
Implementation of the Law on Investment Funds (Official Herald of Republic of Serbia No. 46 from June 2, 2006) commenced on December 11, 2006. The law defines investment fund as an institution for collective investment, which aggregates and invest monetary funds in different types of assets aiming to make a profit and lower the risk of the investment. The goal of the legislator was to provide legal framework for establishing and operating of investment funds as well as to protect small investors according to the EU Directives UCITS 1 and UCITS 2 and international control practise. It is domestic and foreign natural persons and legal entities who may invest through investment funds.

Economic System in the New Constitution of the Republic of Serbia |

By promulgating in the National Assembly of the Republic of Serbia on November 8, 2006, the Constitution of the Republic of Serbia (The Official Herald of the Republic of Serbia No. 83 from October 1, 2006) has entered into force. The third part of the new Constitution, “Economic System and Public Finance”, prescribes the principles of the economic system.

Law on Special Competencies for Efficient Protection of Intellectual Property Rights |

Law on Special Competencies for Efficient Protection of Intellectual Property Rights (“Official Herald of RS” No. 46 dated 2 June 2006) entered into force on 10 June 2006. The Law provides specific measures the state bodies (market and other inspections, tax inspectors, tax police and Republic Broadcasting Agency, hereinafter referred to as: body) are authorised to take in order to protect the IP rights recognised by the domestic law and international agreements. While the other laws in this field provide the protection only in court proceedings inferring sophisticated and often slow procedure, the Law allows direct involvement of administrative bodies in urgent procedure.
